President Trump says ‘inconceivable’ that Cohen recorded conversation about ex-Playmate payment

DONALD TRUMP was secretly recorded by Michael Cohen, his personal lawyer, discussing hush payments to a former Playboy model who claims she had an affair with him, according to reports yesterday. Most states, including NY, allow for recordings of conversations with only the consent of one party; other states require all parties to agree to a recording or have mixed laws on the matter. He continued, "Coordinated expenditures are treated as in-kind contributions under campaign finance law and corporations are prohibited from contributing to federal candidates, so AMI's payment to McDougal [would be] an illegal corporate contribution to Trump".

Giuliani confirmed to ABC News that the president did have a discussion with Cohen before the election, but the former New York City mayor said the payment to McDougal discussed on that call was never made. A source with knowledge of Cohen's legal team, however, said it was a "very foolish strategy by Team Trump".

The tabloid ultimately sat on it, preventing it from becoming public. Two other sources said that beyond the tape with the President there were other recordings of "powerful" people speaking with Cohen that the Federal Bureau of Investigation seized. According to Giuliani, the record shows that the President "did nothing wrong".

Lanny Davis, one of Cohen's lawyers, claimed in a written statement late Friday that the contents of the recording would not be damaging for his client. It is not immediately clear where Mr Trump and Mr Cohen were located at the time of the call.

After The New York Times first revealed the existence of the tape - and Giuliani claimed the tape was exculpatory evidence that did no harm to Trump -- his legal team made a decision to remove any protection relating to the attorney-client relationship on this specific matter.

Daniels is suing both Trump and Cohen for libel after denying her claims of an affair.

On Saturday, Giuliani told Reuters the conversation was held at Trump's office in Trump Tower and that Cohen used a hidden device to record the conversation.

McDougal also has filed a lawsuit seeking the right to speak publicly about her alleged affair with Trump.

McDougal says she began a almost yearlong affair with Trump in 2006, shortly after Trump's wife, Melania, gave birth to their son Barron.

Giuliani said no campaign funding was involved in the discussion between Trump and Cohen, who has distanced himself from Trump in recent months as the FBI investigates Cohen's business dealings.

McDougal sold her story for $150,000 to The National Enquirer, which was supportive of Trump, during the final months of the presidential campaign. Giuliani says what's important is Trump said that if it were made it should be properly documented.

"In the big scheme of things, it's powerful exculpatory evidence", Mr. Giuliani said.

When questioned about the allegations, President Trump has denied the affair and said he had no knowledge of any payment. "Any attempt at spin cannot change what is on the tape". That conversation took place weeks before Trump's November 2016 election.

The former Playboy model said that after their first sexual encounter, Trump tried to offer her money.

The Justice Department says Cohen has been under investigation for months for criminal conduct largely centred on his personal business dealings.
