European Union court upholds Hamas terror listing

Despite the European Court of Justice (ECJ) ruling which annulled measures against the LTTE, the European Union today said the terror organisation remains listed as a terrorist organisation by the EU.

The EU appealed and Wednesday's ruling by the European Union Court of Justice said that the 2014 annulment was wrong and must now be reconsidered taking into account arguments not ruled upon in the original decision.

In another terror listing case Wednesday, the court upheld a decision ordering the removal of the Sri Lankan rebel group Tamil Tigers from the terror list.

The European Union also has a PNR agreement with the U.S. as well as an internal one among EU member states which could face challenges in light of Wednesday's European Court of Justice ruling.

The Court does not have to but generally does follow the advisory opinion of the Advocate General. It also added that Hamas assets must remain frozen for three months pending an appeal. In the new document, Hamas said it accepts a Palestinian state alongside Israel, a departure from the founding charter which envisioned that state in place of a defeated Israel.

Hamas opposed the sanctions from the start, alluding to its democratic mandate and arguing that it has the right to conduct military operations against the Israeli occupation.

The 1967 borders refer to those that existed before the war in which Israel occupied East Jerusalem, the West Bank and the Gaza Strip.
