Governor's office not notified of DOJ decision

The confrontation began when a 911 caller said a man wearing a red T-shirt selling CDs was armed. Prosecutors said they could not prove the officers acted unreasonably.

The report also said Sterling had a.38-caliber revolver in his pocket - a fact that had been in dispute previously. A focal point of the investigation hinged on whether Sterling had threatened the officers with a gun or if the officers perceived a threat that led them to fire six bullets into his body.

For the Sterling family it feels like the day of the tragedy all over again.

The Department of Justice said its civil rights division; acting U.S. Attorney Corey Amundson and the FBI will be part of the news conference at the federal courthouse in Baton Rouge at 1 p.m. Wednesday. The Justice Department's Civil Rights Division declined to comment on criticism of the office, and White House officials were not immediately available for comment. Lake draws his weapon and yells at Sterling to not move. However, there is additional footage, including dashcam, bodycam, and store surveillance recordings, that have not yet been released which could shed more light on the circumstances surrounding Sterling's death.

Landry said he had taken action "to ensure this matter is investigated by the agency with the most expertise in officer-involved shootings". Sterling did have a gun in his pocket, but did not pull it on the officers. The other officer assists in restraining Sterling.

Was the second series of shots a violation of the Fourth Amendment?

He warned that the review "could take a considerable amount of time" and asked for patience. The Fourth Amendment outlines what constitutes an illegal search and seizure.

Amundson says investigators were not able to determine if Sterling was actually reaching for a gun when officers said he was on the night he was shot in July of 2016.

The two officers, Blane Salamoni and Howie Lake II, were placed on administrative leave.

"Our heart goes out to the family".

Baton Rouge Mayor-President Sharon Weston Broome and Governor John Bel Edwards expressed frustration that the Justice Department's decision had been leaked to news media on Tuesday before Sterling's family was told.

CBS News' Paula Reid reported Tuesday that the Justice Department was expected to close the investigation into Sterling's death and bring no charges in the case.

Sterling's family is urging Attorney General Jeff Landry to do so.

Landry indicated that he would request the investigative material from the Department of Justice and make sure that it gets to the State Police for a state investigation. The U.S. Justice Department has decided not to charg. He said the state's investigation was stalled until the federal investigation was completed.
